Seatbelt Laws in ACT Canberra

According to Australian road rules, seatbelts must:
* be worn properly
* sit over the shoulder
* be positioned correctly at all times

In the ACT, seatbelt laws are set out in the Road Transport (Road Rules) Regulation 2017 (ACT) under the Road Transport (Safety and Traffic Management) Act 1999 (ACT). Seatbelts must be worn securely and correctly, including proper shoulder positioning. Drivers are responsible for passengers

Australia has one of the harshest penalties for seat belt offences in the world, correct as of time of writing:

The penalty is approximately $574 and 3 demerit points. Double demerit periods apply during holiday enforcement periods, and additional fines may apply for each passenger not properly restrained, increasing overall liability. Enforcement includes camera-based detection.

A simple way to protect yourself
You cannot control how every passenger wears their seatbelt.
But you can make it clear. Most seatbelt offences are due to genuine mistakes and passengers are more likely to do the right thing if they know the consequences to you.

Most passengers believe they are wearing a seatbelt correctly. They are not aware that wearing it under the arm or off the shoulder is as bad as not wearing one in Australia. in-car seatbelt alarms also cannot identify when passengers are not wearing seatbelts correctly.
